Publisher: Fencing Companion SAS
Please read this End-User License Agreement (hereinafter referred to as the “Agreement” or “EULA“) carefully before downloading, installing, or using the mobile application Fencing Companion Live (hereinafter referred to as the “Application“).
By installing, downloading, or using the Application, you agree to be bound by the terms of this Agreement entered into with Fencing Companion SAS, a simplified joint-stock company (société par actions simplifiée) registered in France (hereinafter referred to as the “Publisher“). If you do not agree to the terms of this Agreement, please do not install or use the Application.
ARTICLE 1 – PURPOSE AND GRANT OF LICENSE
1.1. Purpose: The purpose of this Agreement is to define the conditions under which the Publisher grants the user (hereinafter referred to as the “User“) a right to use the Application on any compatible mobile device running the Android operating system.
1.2. License Grant: Subject to compliance with the terms of this Agreement, the Publisher grants the User a personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Application for personal or non-commercial sporting purposes.
ARTICLE 2 – BUSINESS MODEL AND THIRD-PARTY SERVICES
2.1. Free Application: Installation and basic use of the Application are 100% free.
2.2. Features Associated with an External Subscription: Certain advanced or integrated features of the Application require an active subscription with a third-party partner website, Escriméo (https://www.escrimeo.com/).
- This Agreement does not govern the pricing or subscription terms of said third-party service. Access to these features is contingent upon maintaining a valid subscription with the publisher of the partner service.
ARTICLE 3 – TECHNICAL FEATURES AND EXTERNAL INTERFACES
3.1. Connection to Electronic Equipment (Bluetooth Low Energy): The Application is designed to communicate via Bluetooth Low Energy (BLE) technology with compatible connected fencing scoring accessories.
- The Application reads and processes fencing match data transmitted by the accessory (specifically touches/hits, timer, and scores).
- The Publisher does not guarantee universal compatibility with all apparatuses on the market, nor the complete absence of radio interference or connection drops inherent to wireless technologies.
3.2. Integration with the Escriméo Platform: The use of an account on the website https://www.escrimeo.com/ is not mandatory to operate the Application, but allows unlocking additional features (specifically data synchronization).
- By logging into your Escriméo account from the Application:
- The Application retrieves your profile identifiers (first and last name) from the Escriméo platform.
- The Application transmits fencing match data to the Escriméo platform.
- The Publisher does not manage the credentials or security of Escriméo accounts, which remain the sole responsibility of the publisher of the Escriméo platform.
ARTICLE 4 – DATA PROTECTION AND PRIVACY
4.1. Processing by Fencing Companion SAS: Fencing Companion SAS does not retain, exploit, or commercialize any identifying personal data or match data retrieved or transmitted by the Application.
- The Application acts solely as a technical gateway between the connected apparatus, the Android device, and the partner platform Escriméo.
4.2. Android System Permissions: The Application requires certain permissions on your mobile device (specifically access to Bluetooth / Location features according to Android system requirements for BLE scanning). These permissions are strictly limited to the proper functioning of the technical features described in Article 3.
ARTICLE 5 – RESTRICTIONS ON USE
The User is strictly prohibited from:
- Modifying, adapting, translating, disassembling, decompiling, reverse engineering, or attempting to extract the source code of the Application, in whole or in part;
- Selling, renting, sublicensing, distributing, or transferring the Application to any third party;
- Using the Application for illegal, fraudulent purposes, or in any manner likely to disrupt the operation of connected apparatuses or third-party partner servers.
ARTICLE 6 – INTELLECTUAL PROPERTY
The Application, its source code, architecture, visual interfaces, logos, trademark, and all proprietary content belonging to Fencing Companion SAS are and remain the exclusive property of Fencing Companion SAS and are protected by French and international intellectual property laws.
No ownership rights are transferred to the User under this Agreement, with the exception of the right of use expressly granted in Article 1.
ARTICLE 7 – DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
7.1. “As Is” Provision: The Application is provided “as is” and “as available”, without warranty of any kind, express or implied, regarding its uninterrupted operation, the absolute accuracy of recorded scores, or compatibility with all Android devices.
7.2. Limitation of Liability: To the fullest extent permitted by applicable law, Fencing Companion SAS shall not be liable for any direct or indirect damages, loss of data, interruptions of refereeing or competitions, hardware malfunctions of the connected apparatus, or service interruptions on the third-party website Escriméo.
- The User acknowledges that the display of scores and timers via the Application is provided for sporting and informational purposes only, and does not replace the official decisions of certified referees.
ARTICLE 8 – TERMINATION
This Agreement remains in effect until terminated.
- By the User: The User may terminate the Agreement at any time by uninstalling and permanently deleting the Application from their device.
- By the Publisher: The Publisher may terminate this license without prior notice in the event of any breach by the User of any provision of this Agreement.
ARTICLE 9 – GOVERNING LAW AND JURISDICTION
This Agreement is governed by and construed in accordance with French law.
In the event of any dispute concerning the validity, interpretation, or performance of this Agreement, the parties shall endeavor to reach an amicable settlement. Failing an amicable resolution within a reasonable time, the dispute shall be subject to the exclusive jurisdiction of the competent French courts.
